SCOTUS overturns 5th Circuit ruling that told ISP to kick pirates off Internet

The US Supreme Court overturned a 5th Circuit ruling that held ISP Grande Communications liable for contributory copyright infringement, requiring it to terminate subscribers accused of piracy. The decision follows a similar precedent set last month in Cox v. Sony, establishing that ISPs aren't liable merely for providing service to users who may infringe copyright. The case has been remanded back to the 5th Circuit for reconsideration in light of the Cox ruling.

Background

Record labels have been pursuing legal action against ISPs for not taking action against subscribers repeatedly accused of copyright infringement through torrenting. The 5th Circuit had previously ruled in favor of holding ISPs liable for contributory infringement.
