US officials want Section 702 renewed before damaging court ruling goes public

Two Democratic senators allege the Trump administration is deliberately withholding a secret FISC ruling that criticized warrantless surveillance search filters, until after Section 702 is renewed by Congress. Senators Wyden and Schiff have demanded the administration explain the delay and name responsible officials by November 6, warning that transparency is essential for public trust.

Background

Section 702 of the Foreign Intelligence Surveillance Act (FISA) authorizes warrantless surveillance of non-US persons abroad but has been repeatedly renewed amid controversy over incidental collection of Americans' communications. The program's authorization lapsed in June 2026, creating urgency for Congressional action.
